What these terms cover
These Terms and Conditions govern your use of talking-portfolio.com and your purchase of a Talking Portfolio Build Spot and, where activated, the related monthly hosting service called Rent.
They form the contract between you and Sonja Laser EI, trading as Talking Portfolio. The version accepted at checkout applies to your Build Spot. The Rent terms continue for as long as that subscription remains active.
If you buy for purposes that are mainly outside your trade, business, craft, or profession, you may have mandatory consumer rights. Nothing here removes them.

Ordering a Build Spot
You must be at least 18 and legally able to enter a contract. If you order for an organisation, you confirm that you have authority to bind it.
The Build Spot is sold through a Bumpsale button connected to Stripe. Bumpsale changes the available price after each completed sale. The amount displayed in the checkout you approve is the binding one-time Build Spot price. A later buyer may pay a different amount. That is the mechanism, not a pricing accident.
You can review and correct the information in the Stripe checkout before confirming payment. Your order becomes binding when payment is accepted and an order confirmation is sent to the email address you supplied. Please save that confirmation and these terms.
All prices are shown in euros. No VAT is added because VAT is not applicable under article 293 B of the French General Tax Code.
The Build Spot pays for the custom build. Rent pays for ongoing hosting and service after go-live. Buying a Build Spot does not buy the underlying platform or include indefinite hosting.
The Build Spot
Unless the order page or a written agreement says otherwise, one Build Spot includes:
- one hosted Talking Portfolio;
- up to six projects or case studies, created from the usable source material you provide;
- an AI chat configured around your work and approved persona material;
- one consolidated revision round; and
- delivery targeted within seven working days after Talking Portfolio confirms that Intake is complete, with any campaign queue date communicated in advance.
Complete Intake means that all required questions, source links, permissions, and Rent activation have been received and are usable. If materials are thin, incomplete, inaccessible, or unsuitable, fewer than six case studies may be delivered rather than creating extra unagreed work.
Campaign orders are handled in purchase order, with no more than two active builds at a time. You will receive a queue estimate before Intake is confirmed complete. Once Talking Portfolio confirms that your Intake is complete, the seven-working-day build period starts.
One revision round means one consolidated set of reasonable changes within the agreed scope. Fixes needed to meet the agreed scope are not treated as optional revisions. New pages, extra projects, new features, repeated preference changes, copywriting beyond the agreed extraction work, custom integrations, paid third-party services, and a custom domain are outside scope unless agreed in writing.
Monthly Rent
Rent is a separate monthly subscription. You activate it during Intake by authorising Stripe to store your payment method. The first Rent charge is scheduled for go-live. If the go-live date changes, the trial or first billing date will be adjusted.
The portfolio will not be made public until the first Rent payment succeeds, unless Talking Portfolio confirms a different arrangement in writing. Rent then renews monthly until cancelled. There is no minimum commitment beyond each paid monthly period.
If a payment fails, Stripe retries it and emails you a reminder. If the payment still has not gone through 10 days after the first failed attempt, the portfolio goes offline. A 30-day offboarding period then allows you to request an export of the content you supplied. Reactivation after offboarding costs €25, plus any unpaid amounts.
Referral month. Your purchase confirmation contains a personal referral link. For each person who buys a Build Spot through your link and completes Intake, your Rent for one month is free. The free month is applied to your next Rent charge; it has no cash value and cannot be exchanged. If your portfolio is not live yet, it is applied to your first charge.
Your part
Your job is Intake. Small sentence, real responsibility.
You agree to:
- provide accurate contact, billing, project, and persona information;
- provide usable source links or files and respond to questions needed to complete the work;
- review previews and send revision feedback in one consolidated message;
- only provide material that you own or are authorised to use, adapt, publish, and provide to AI and hosting suppliers for this service;
- obtain any necessary permission from people shown or named in your material; and
- avoid supplying unlawful, infringing, discriminatory, deceptive, malicious, or unnecessarily sensitive personal data.
Delays caused by missing access, late feedback, rights questions, or incomplete materials pause the delivery schedule. Talking Portfolio may refuse content that creates legal, security, or reputational risk.
The AI chat is not you
The chat is an automated representation built from approved portfolio and persona material. It is not a live conversation with you and must be presented as AI. You authorise Talking Portfolio and its AI service providers to process the supplied material as needed to configure and operate it.
AI can produce incomplete or inaccurate answers. Talking Portfolio will use reasonable care to configure the chat and correct reproducible problems, but does not promise that every answer will be perfect. Visitors should verify important information directly with you.
Rent currently includes up to 300 visitor chat messages per portfolio per monthly billing period. If the fair-use limit is reached, the chat may pause and show a contact option until the next period. Limits may change under section 14 if actual service costs or abuse patterns require it.
You must not use the service to impersonate another person, automate regulated professional advice, process special-category personal data without a lawful basis and written agreement, or generate unlawful content.
Content and rights
Your material stays yours
You retain ownership of the text, images, video, logos, trademarks, and other source material you provide. You grant Talking Portfolio a worldwide, non-exclusive licence for the duration of the service and offboarding period to copy, adapt, format, host, display, transmit, back up, and process that material only as needed to build, operate, support, and secure your portfolio.
The platform stays ours
Talking Portfolio and its licensors retain all rights in the software, templates, layouts, prompts, workflows, methods, platform components, and pre-existing materials used to provide the service. Your payment gives you the hosted service described here. It does not transfer source code, infrastructure, templates, AI configurations, or ownership of the platform.
Offboarding
During the 30-day offboarding period, you may request an export of the source content you supplied and any final text created specifically from it. The export does not include platform code, templates, system prompts, infrastructure, or third-party software. A custom domain that you own remains yours and can be pointed elsewhere.
Consumer right of withdrawal
If you are an eligible consumer in the European Union, you normally have 14 calendar days from the date the contract is concluded to withdraw without giving a reason.
To meet a seven-working-day build schedule, Talking Portfolio will ask you during Intake to expressly request that work begins before the 14-day period ends. If you then withdraw before the service is fully performed, you must pay a proportionate amount for work already completed up to the time you notify us. If the service is fully performed during the withdrawal period after your express request and acknowledgement, you lose the right to withdraw from that fully performed service.
The Rent subscription is a separate service. Where consumer withdrawal rights apply and Rent has started at your express request, any amount due on withdrawal is calculated in accordance with applicable law.
Send an unambiguous withdrawal statement to hey@talking-portfolio.com before the deadline. You may use the model below, but you do not have to.
Model withdrawal form
To: Sonja Laser EI, Talking Portfolio, 59 rue de Ponthieu, Bureau 326, 75008 Paris, France, hey@talking-portfolio.com
I hereby give notice that I withdraw from my contract for the following service: [Build Spot and/or Rent].
Ordered on: [date]
Name: [your name]
Address: [your address]
Date: [date]
Approved refunds are made using the original payment method within the period required by law. This section does not limit any rights you may have if the service is not provided as agreed.
Cancelling Rent
You may cancel Rent at any time, without a cancellation fee, by using the electronic cancellation function made available on talking-portfolio.com or by writing to hey@talking-portfolio.com. Include the account name, purchase email, and portfolio address so the correct subscription can be found.
Cancellation normally takes effect at the end of the current paid billing period. Unless required by law, a partial month is not refunded. The portfolio may then be taken offline and enters the 30-day offboarding period described above.
Talking Portfolio will confirm receipt and the effective cancellation date by email. Cancelling Rent does not refund the separate Build Spot or erase payment and invoice records that must be retained by law.
Availability and changes
Talking Portfolio uses third-party hosting, database, payment, network, and AI services. Reasonable care is taken to keep portfolios available and secure, but uninterrupted or error-free operation cannot be guaranteed.
Maintenance, security work, provider outages, internet failures, force majeure events, or urgent abuse prevention may temporarily limit access. Where practical, planned material downtime will be communicated in advance.
Features may be adjusted to maintain security, legal compliance, accessibility, or service reliability. A material reduction to the paid service will be notified and handled under section 14.
Consumers benefit from any mandatory legal guarantee of conformity that applies to digital content or digital services. Contact Talking Portfolio first so a defect can be investigated and corrected. These statutory rights are not limited by this section.
Responsibility without theatre
Each party is responsible for loss that is a direct and reasonably foreseeable result of its breach. Talking Portfolio is not responsible for losses caused by inaccurate or unlawful buyer material, instructions it reasonably followed, unauthorised third-party changes, or failures outside its reasonable control.
Talking Portfolio does not guarantee search ranking, sales, job offers, enquiries, visitor numbers, or any other commercial outcome. A portfolio can explain good work. It cannot manufacture good work, or make the internet behave.
For customers acting for professional purposes, and to the extent permitted by law, Talking Portfolio's total liability arising from the service is limited to the fees that customer paid to Talking Portfolio during the 12 months before the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot legally be excluded, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer rights.
Ending the service for breach
Talking Portfolio may suspend or end the service if you materially breach these terms, do not pay amounts due, infringe another person's rights, create a security risk, abuse the AI chat, or use the service unlawfully.
Where the problem can reasonably be fixed, you will normally receive written notice and a reasonable opportunity to fix it. Immediate action may be taken for urgent security, legal, fraud, or safety reasons. Ending for breach does not remove payment obligations already incurred.
Changes to terms or Rent
Changes to Build Spot terms do not rewrite an order already accepted unless you agree or the law requires it.
For an active Rent subscription, Talking Portfolio may update these terms, the monthly price, or fair-use limits for legal, security, technical, or sustainable service reasons. Material changes will be sent by email at least 30 days before they take effect. If you do not accept a material change, you may cancel Rent before its effective date.
Complaints, disputes, and law
Start with a human email: hey@talking-portfolio.com. Describe the problem, the order email, and the outcome you want. Talking Portfolio will try to resolve it directly.
If you are a consumer and the complaint is not resolved, you may use the consumer mediation service designated by Talking Portfolio, free of charge, once its contact details have been supplied to you. Those mediator details must also appear on this page before consumer sales open.
These terms are governed by French law. If you are a consumer resident elsewhere, you keep any mandatory protections given by the law of your country of residence. Competent courts are determined by applicable law; no clause here forces a consumer to give up a legally available court.
